What is compelling the failure to prosecute?
One might lose a case, but if the victim is willing to testify, shouldn't they prosecute anyway?
The American Bar Association standard for prosecution is "sufficient evidence to support a finding of guilt."
If you have victim testimony, especially when supported by evidence from a rape kit, why not go to trial?
